Use of this website is subject to these Terms & Conditions and our Privacy Policy which you can access here (together, our Terms). Please read the Terms carefully as they apply to your use of the website. If you have any queries about these Terms, please contact us by email ([email protected]).

Wedit reserves the right to review and modify the Terms and website content (Website Content) at any time and without notice. Your use of the website and access to the Website Content will be regarded as your acceptance of these Terms, as amended from time to time.

About Wedit

Wedit is a wedding and event registry platform that facilitates the creation of an online registry (Registry) relating to an upcoming wedding or event (Event) by a registered member (Host). We offer a comprehensive, curated range of gift categories and invite guests to contribute to the Host’s Registry in the form of monetary gifts or Gift Cards (as applicable) (Gifts). These Terms apply to the creation of, access and contribution to any Registry.

Personal Use

You are authorised to access the website to download and view Website Content for personal, non-commercial use. You must not use the Website Content for commercial purposes or for any purpose that is unlawful.

Creating a Registry

To create and access a Registry you must create a Host account with Wedit. The Registry may include one or more gift categories as curated by the Hosts (Gift Categories).

By creating an account, you acknowledge that:

(a) you have read, understood, and agree to the Terms; and

(b) you are at least 18 years old and possess the legal right and ability to enter into a legally binding agreement with us.

As part of the registration process, you will be required to provide us with personal information such as your name, address, email address, bank account and Event details. You warrant that this information is current and accurate. We will handle all personal information we collect in accordance with our Privacy Policy.

You are responsible for keeping your password and login details secure. You are responsible for all use and activity carried out under your account. It is the responsibility of the Host to provide Wedit with their correct bank account details for Gifts to be transferred to them.

How the Registry works

The following are the terms that apply to Gifts made to a Registry:

  • (a) Contribution to a Gift Category. A Host may invite Guests to visit the Host’s Registry and purchase or contribute (as applicable) to a relevant Gift Category. If a Guest purchases or contributes a Gift (as applicable), the Guest must select the Gift amount and pay any applicable fees or charges to us.
  • (b) Wedit is an intermediary platform. We act as an intermediary platform between the Host and Guests. We are not a financial institution, payment processor, gift shop, creditor, or charity. Any dispute regarding a Gift is a matter between the Guest and Host, not us.
  • (c) Our fees and charges. We may apply fees and charges to a Host and Guest, who must pay any fees and charges to us. The applicable fees and charges will be provided on our website, as amended from time to time. Please refer to clause 5 for details of the applicable fees and charges.
  • (d) We hold the Gifts. We or our nominee will temporarily hold the balance of the clear funds that we receive as Gifts from the Guests (less any applicable fees or charge which are payable to us or as otherwise authorised under these Terms) for the Host. In accordance with these Terms, we are entitled to retain any interest earned on the Gifts.
  • (e) Transfer of Gifts to the Host. Our only duty is to transfer the Gifts to the Host. We may electronically transfer the Gifts to the Host 7 days after the Event date or Revised Date (refer to clause 6). Before making a transfer, we may deduct from the funds any amounts that are owed to us, including fees and charges. We are not obliged to transfer any Gifts to the Host that have not cleared, or we reasonably believe have been improperly or unlawfully obtained.
  • (f) The Host may use the Gifts in its discretion. The Host is not obliged to use the Gifts to purchase goods or services that meet the description of the relevant Gift Categories under which the Gift is made. You accept the Host has complete discretion to apply the Gifts as the Host sees fit.

Fees and Charges

Payment of applicable fees and charges is subject to these Terms. Unless otherwise stated, all fees displayed on the website or quoted by an authorised representative of us are in Australian Dollars (AUD), non-refundable and GST inclusive.

Each Registry will incur a one-time fixed fee of 3.5% of the total funds collected by the Registry (Service Fee). The Service Fee will be automatically deducted from the total funds upon closure of the Registry (being 7 days post the Event as advised by the Host upon creation of the Registry). Each Host will be responsible for payment of the Service Fee.

Each Gift contributed to a Registry by a Guest will incur a standard payment processing fee of 2.9% + $3.05 (calculated based on total Gift amount), which will be added to the total at the time of checkout. This fee is standardised across all domestic/international cards, including AMEX.

Chargebacks and payment disputes will incur a processing fee of $25.

You acknowledge and agree that we are entitled to retain any interest earned on the Gifts held on behalf of the Host, and that interest will not be transferred to the Host upon closure of the Registry.

Postponements and Cancellations

We may, at our sole discretion, refund a Gift to a Guest following receipt of written notice. We are unable to refund interest earned, transaction fees and Gift Card purchases associated with a Gift.

The Host is permitted to update the Event date once (Revised Date).

If the Event is postponed or cancelled, the Host may request in writing:

  • (a) that the Registry details be changed to reflect the Revised Date; or
  • (b) that the Registry be closed to Guests and the Gifts (excluding Gift Cards) be refunded by us to Guests.

If the Event does not proceed on the Revised Date, the Registry will be closed, and the Gifts refunded to the Guests (excluding interest, transaction fees and Gift Card purchases).

A Host may cancel the Registry [without charge] if no Gifts have been purchased or contributed to that Registry.

Our rights

Wedit reserves the rights to, in its sole discretion:

  • (a) make changes to the website and services;
  • (b) cancel any Gift made to any Registry; or
  • (c) reject, cancel, or remove any Registry.

Wedit has discretion with respect to commenting on or explaining any such action.

Wedit agrees to refund any Gift made to any Registry which is cancelled or removed (excluding any interest, transaction fees and Gift Card purchases).

Third party payment system

Wedit reserves the rights to, in its sole discretion:

  • make changes to the website and services;
  • cancel any Gift made to any Registry; or
  • reject, cancel, or remove any Registry.

Wedit has discretion with respect to commenting on or explaining any such action.

Wedit agrees to refund any Gift made to any Registry which is cancelled or removed (excluding any transaction fees and Gift Card purchases).

Website Content

The Host is solely responsible for ensuring that their bank account details recorded in our system are correct. We are not responsible for any unlawful activity with respect to the Host’s account, unless caused by Wedit.

The information on our website is not comprehensive and is intended to provide a summary of the subject matter covered. While we use all reasonable attempts to ensure the accuracy and completeness of the information on our website, to the extent permitted by law, including the Australian Consumer Law, we make no warranty regarding the information on this website. You should monitor any changes to the information contained on this website.

Promotions and competitions

For certain campaigns, promotions or contests, additional terms and conditions may apply. If you want to participate in such a campaign, promotion or contest, you need to agree to the relevant terms and conditions applicable to that campaign, promotion or contest. In case of any inconsistency between such terms and conditions and these Terms, those terms and conditions will prevail.

Exclusion

In Australia, our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). Nothing in these terms and conditions purports to modify or exclude the conditions, warranties and undertakings, and other legal rights, under the Australian Competition and Consumer Act and other laws. Any and all other warranties or conditions which are not guaranteed by the Australian Consumer Law or the Competition and Consumer Regulation 2010 are expressly excluded where permitted, including liability for incidental or consequential damages caused by breach of any express or implied warranty or condition.

Our website may contain links to websites operated by third parties. Those links are provided for convenience and may not remain current or be maintained. Unless expressly stated otherwise, we do not endorse and are not responsible for the content on those linked websites and have no control over or rights in those linked websites.

Intellectual property rights

The Website Content is protected by copyright and other intellectual property laws. All intellectual property in relation to the Website Content belongs to Wedit, its licensors, or its affiliates.

The Website Content and the website as a whole are intended solely for your personal, non-commercial use. Any use of the Website Content for purposes other than personal and non-commercial use, or for any other use, including the modification, reproduction, distribution, transmission, republication, display or performance, of the content of this website, is prohibited without the prior written permission of Wedit.

If you seek to reproduce or otherwise use the Website Content in any way, it is your responsibility to obtain approval for such use where necessary.

The website may contain the names and trademarks of other entities. Wedit does not authorise you to use these names or trademarks in any way, and their inclusion does not indicate that such entities endorse Wedit, or the Website Content, in any way.

Unacceptable activity

You must not do any act that we would deemed to be inappropriate, is unlawful or is prohibited by any laws applicable to our website, including but not limited to:
any act that would constitute a breach of either the privacy (including uploading private or personal information without an individual’s consent) or any other of the legal rights of individuals;

If we allow you to post any information to our website, we have the right to take down this information at our sole discretion and without notice.

You represent and warrant that you will use this website only in accordance with these Terms and any information you provide via this website will not be in any way misleading, deceptive or likely to mislead or deceive.

To the maximum extent permitted by law, including the Australian Consumer Law, we make no warranties or representations about this website or the Website Content, including but not limited to warranties or representations that they will be complete, accurate or up to date, that access will be uninterrupted, error-free, free from viruses, or that this website will be secure.

We reserve the right to restrict, suspend or terminate without notice your access to this website, any Website Content, or any feature of this website at any time without notice and we will not be responsible for any loss, cost, damage or liability that may arise as a result.

We do not undertake to keep the website updated. We are not liable to you or anyone else if errors occur in the information on the website or if that information is not up to date.

Severance

If any provision of these Terms is determined to be unlawful, void or unenforceable, such provision will be deemed to be severed from the Terms and will not affect the validity and enforceability of any of the other remaining provisions.

Jurisdiction and governing law

These Terms shall be governed by and interpreted in accordance with the laws of Western Australia. This website may be accessed in Australia and throughout the world. Wedit makes no offer in or by this website to sell any product or service in any country outside Australia and no representations that the website Content complies with the laws of any country outside Australia. If you access this site from outside Australia, you do so at your own risk and are responsible for complying with the laws in the place where you access the site.
